ADA Requirements for Passenger Carriers
The Americans with Disabilities Act (ADA) Title III imposes specific requirements on private passenger carriers operating fixed-route services. Fixed-route operators must provide equivalent service to passengers with disabilities. Over-the-road coach operators with 100 or more employees must have an accessible vehicle in service on every fixed route by a specified compliance date, and must provide equivalent service to wheelchair users including advance-notice boarding assistance. FMCSA regulations under 49 CFR Part 37 require that bus drivers assist passengers with disabilities with boarding and alighting, securing wheelchairs, and storing mobility devices at no additional charge. The driver may not require advance notice for accessibility assistance except for over-the-road coaches where advance notice (typically 48 hours) may be required for lift-equipped vehicle deployment. The driver is required to provide assistance but may not physically lift or carry a passenger without the passenger's explicit consent. Passengers have the right to self-direct their transfer and boarding method. For transit bus operations, all vehicles acquired after 1990 must be wheelchair accessible with functional lifts or ramps. If a vehicle lift malfunctions, the carrier must provide equivalent transportation within a specified timeframe β typically 30 minutes for urban transit systems.
